সাধারণ :

বিক্রয়ের বর্তমান নিয়ম ও শর্তাবলী (“নিয়ম ও শর্তাবলী”) https://egrahok.com/ ওয়েবসাইটে (“সাইট”) আপনার কাছে বিক্রি হওয়া সমস্ত পণ্যের জন্য প্রযোজ্য (“গ্রাহক”), “ই গ্রাহক” দ্বারা পরিচালিত। এই নিয়ম ও শর্তাবলী কোন পূর্ববর্তী শর্তাবলী বা গ্রাহকের যে কোন সাধারণ বা নির্দিষ্ট শর্তাবলীকে বাতিল করে। সাইটে স্থাপিত প্রতিটি পণ্য অর্ডার শর্তাদি এবং শর্তাবলী গ্রাহকের দ্বারা গ্রহণযোগ্যতা অনুমান করে এবং গ্রাহক এই শর্তাবলী দ্বারা আবদ্ধ হবে।

মূল্য নির্ধারণ এবং মূল্য হ্রাস/সংশোধন :

”ই গ্রাহক” গ্যারান্টি দেয় যে ক্রয়ের দিন মূল্য ডেলিভারির তারিখ পর্যন্ত বৈধ থাকবে। তার মানে আপনার অর্ডার করার প্রক্রিয়া শেষ হওয়ার পরে যদি দাম বেড়ে যায়, তাহলে দাম বৃদ্ধির জন্য আপনাকে চার্জ করা হবে না এবং অর্ডার মূল্য থেকে কোনো মূল্য কমে গেলে কোনো সমন্বয় করা হবে না।
পণ্য(গুলি) মূল্য সংক্রান্ত সমস্যাগুলির জন্য সমস্ত অধিকার ”ই গ্রাহক” দ্বারা সংরক্ষিত। ”ই গ্রাহক” যেকোনও সময় কোনো পূর্ব বিজ্ঞপ্তি ছাড়াই অফার(গুলি) পরিবর্তন বা বন্ধ করতে পারে।
তালিকাভুক্ত মূল্যের মধ্যে ট্যাক্স/ভ্যাট অন্তর্ভুক্ত থাকে যদি না অন্যথায় বলা হয় এবং ডেলিভারি চার্জ তালিকাভুক্ত মূল্যে অন্তর্ভুক্ত করা হয় না.

পেমেন্ট এবং অর্ডার প্রক্রিয়া :

সাইট থেকে কেনাকাটা করার জন্য, আপনাকে একটি বৈধ ফোন নম্বর এবং পাসওয়ার্ড ব্যবহার করে নিবন্ধন করতে হতে পারে। এই ধরনের তথ্য/লগ-ইন বিশদ নিরাপদ এবং গোপন রাখা আপনার একমাত্র দায়িত্ব। গ্রাহকের দ্বারা তৃতীয় পক্ষকে এই ধরনের তথ্য/লগ-ইন বিশদ প্রদান করা হলে বা গ্রাহকের অবহেলার কারণে এবং গ্রাহকের কোনো ক্ষতির জন্য যদি কোনো তৃতীয় পক্ষ তা গ্রহণ করে তাহলে ‘ই গ্রাহক’ দায়ী থাকবে না উপরে উল্লিখিত ঘটনা (ডেটা অনুমোদিত অ্যাক্সেস)।

ভুলতা দাবিত্যাগ :

ফোর্স ম্যাজিউরের ক্ষেত্রে ই-গ্রাহক দায়বদ্ধ থাকবে না (অর্থাৎ যে সমস্ত পরিস্থিতিতে ই-গ্রাহকের জন্য বিক্রয় চুক্তির অধীনে তার বাধ্যবাধকতাগুলি মেনে চলা খুবই কঠিন, যার মধ্যে বিপর্যয়, আগুন, বন্যা, ভূমিকম্প, উপাদানগুলি সহ কিন্তু সীমাবদ্ধ নয় প্রকৃতির, ঈশ্বরের কাজ, প্রকৃত বা হুমকিপ্রাপ্ত সন্ত্রাসী হামলা, যুদ্ধের কাজ, নাশকতা, বিস্ফোরণ, দাঙ্গা, নাগরিক ব্যাধি, বিদ্রোহ, বিপ্লব এবং ধর্মঘট, লকআউট বা শ্রম বিরোধ, সরকারী কাজ, দুর্ঘটনা বা উদ্ভিদ বা যন্ত্রপাতি ভেঙ্গে যাওয়া, ত্রুটি তৃতীয় পক্ষের সফ্টওয়্যার, উপকরণের ঘাটতি, পরিষেবা প্রদানে একটি ইউটিলিটি প্রদানকারীর ব্যর্থতা (বিদ্যুৎ, গ্যাস, নেটওয়ার্ক বা টেলিকম প্রদানকারী সহ) এবং তৃতীয় পক্ষের যেকোনো ক্রিয়াকলাপ বা তার যুক্তিসঙ্গত নিয়ন্ত্রণের বাইরে থাকা)।

দায়বদ্ধতা সীমাবদ্ধতা :

”ই গ্রাহক” কোনো পরোক্ষ ক্ষতি, ফলস্বরূপ ড্যামেজ, তথ্য হারানো, আয় বা লাভের ক্ষতি, সম্পত্তির ক্ষতি, জোরপূর্বক ঘটনা, প্রযুক্তিগত ত্রুটি এবং অনিবার্য পরিস্থিতির কারণে ব্যর্থতা/বিলম্ব এবং/অথবা তৃতীয় পক্ষের দাবির জন্য ‘ই গ্রাহক’ কোনো দায় স্বীকার করে না যেমন আমাদের অগচরে আমাদের সাইট এবং ক্রয় করা কোনো পণ্য তৃতীয় পক্ষের বলে চালিয়ে দেয়া।

প্রযোজ্য আইন :

শর্তাবলী বাংলাদেশের আইন দ্বারা নিয়ন্ত্রিত এবং অনুসৃত হয়।

The present Terms and Conditions of Sale (“Terms and Conditions“) apply to all products sold to you (the “Customer.“) on the website https://egrahok.com/ (the “Site“), operated by “E-Grahok“. These Terms and Conditions supersede any prior terms and conditions or any general or specific terms and conditions of the Customer. Every product order placed on the Site presupposes the acceptance by the Customer of the Terms and Conditions and the Customer shall be bound by these Terms and Conditions.

In addition, the general use of the Site is subject to these Terms & Conditions of Use. E GRAHOK reserves the right to vary and/or alter these Terms and Conditions at any time without notice and without assigning any reason thereof and accordingly the revised version shall apply.

Pricing and Price Reductions/Corrections :

E-Grahok guarantees the price as of the purchase day will remain valid till the delivery date. That means after the completion of your ordering process if the price increases, you will not be charged for price increment; and no adjustment shall be made if any price decreases from the order price.

For product(s) pricing issues all rights are reserved by E-Grahok. E-Grahok can change or close the offer(s) at any time without any prior notification.

Listed prices include tax/Vat unless stated otherwise. However, the delivery charge is not included in the listed price.

Payment & Ordering Process :

In order to purchase from the Site, you may be required to register using a valid phone number and password. It is your sole responsibility to keep such information/log-in details secure and confidential. E-Grahok shall not be responsible if such information/log-in details are provided to a third party by the Customer or if any third party receives the same due to the negligence of the Customer and for any loss incurred by the Customer as a consequence of the above-mentioned incidents (unauthorized access of data).

Force Majeure :

E-Grahok shall not be liable in case of Force Majeure (i.e. all situations under which it is very difficult for E-Grahok to comply with its obligations under the sales agreement, including but not limited to disaster, fire, flood, earthquake, elements of nature, acts of God, actual or threatened terrorist attacks, acts of war, sabotage, explosion, riots, civil disorders, rebellions, revolutions and strikes, lockouts or labor disputes, government acts, accidents or breakdown of plant or machinery, bugs in third party software, shortage of materials, failure by a utility provider (including electricity, gas, network or telecom provider) to provide services and any actions or omissions of third parties beyond its reasonable control).

Limitation of Liability :

E-Grahok does not accept any liability for any indirect loss, consequential loss/damage, loss of data, loss of income or profit, damage to property, force majeure situations, failure/delay due to technical errors and unavoidable circumstances and/or claims of third parties for the use of the Site and any product purchased.

Applicable law :

The Terms and Conditions are governed by and construed in accordance with, the laws of Bangladesh.
